Bill to give statutory backing to SC/ST Reservation in posts introduced in Parliament

Minister of State for Personnel, Public Grievances and Pensions Shri Prithviraj Chavan tabled in Rajya Sabha the Scheduled Castes and the Scheduled Tribes (Reservation in Posts and Services) Bill 2008.

The Bill seeks to give statutory backing to the instructions in the matter, the Government decided to enact a suitable legislation which will elevate the provisions of the reservation to a statutory right and also instill greater confidence amongst members of the Schedules Castes and the Scheduled Tribes. It will go a long way in meeting the constitutional goal of securing justice, liberty and equality for all citizens of the country and in promoting fraternity amongst them all.

At present, administrative instructions issued by the Central Government from time to time, provide reservation of appointments or posts for the Scheduled Castes and the Scheduled Tribes in civil services under the control of the Central Government. These instructions have been issued in pursuance of clauses (4) and (4A) of article 16 and the proviso to article 335 of the Constitution of India which empower the State to make provisions for reservation of appointments or posts in favour of the Scheduled Castes and the Scheduled Tribes.

Reappointment of IIT Madras Director Set aside by Madra HC

The Madras High Court set aside the re-appointment of Indian Institute of Technology-Madras (IIT-M) Director M S Anand.

Justice K Chandru set aside the re-appointment of Mr Anand for a second term, allowing a writ of quo warranto in what capacity Mr Anand was continuing as Director of IIT, filed by an engineer and alumnus of IIT-M, Mr K Venkatesan.

The judge held that the re-appointment of Mr Anand for a tenure had to be set aside as the principle of superannuation does not apply in this case.

‘Tenure means, a term, during which office is held once a person is appointed for a post. The appointment to the said post begins when he joins and comes to an end on completion of tenure, unless untouched on justifiable grounds. Such a person does not perannuate’
, the judge said.

In the case of Mr Anand, he went out of office on completion of tenure. Hence the court set aside his re-appointment, the judge said and appreciated the petitioner for correctly contending that the
‘post had been kept warmed up for Mr Anand to occupy’.

Mr Anand must have had prior intimation about his selection for a second term, which could be seen from the purchase of stamp paper much in advance to enter into an agreement, the Judge observed.

Justice K Chandru also directed Mr Anand to pay the petitioner a sum of Rs 5,000 towards cost of the petition.

Sale and Receipt of Application Form.

Fees for information Brochure and application form is Rs. 600/- for open category candidates and Rs. 400/- for backward class category candidates belonging to Maharashtra State (i.e. Candidates having relevant Backward Class Caste Certificate stating that the caste is recognized in the State of Maharashtra and also Non-creamy Layer Certificate (for SBC, NT-A (VJ/DT), NT-B, NT-C and OBC Candidates) issued by Maharashtra State authorities. Fees should be paid by Cash/ Demand Draft / Pay Order of any Nationalized/ Scheduled/ Private sector Commercial bank drawn in favour of ‘Director, College of Engineering, Pune’ payable at Pune. No other mode of payment shall be permitted. This fee is non-refundable and non-transferable under any circumstances.

Depending on the claim of a category, different sets of documents ( Caste certificate, Caste validity certificate and Non-Creamy Layer certificate) are necessary at the time of submission of application form itself without which candidates shall not get the category benefit and will be treated as general category candidates.

Candidate should carry all the original documents for scrutiny at ARCs. If requisite attested photocopies are not attached to application form the candidate may lose the claim of the respective type of candidature. The incomplete or incorrect filled up application forms may be rejected at any stage of CAPCAI and in such cases the candidate will be responsible for the rejection of the application form. Application form submitted should be confirmed by the candidate in person at any ARC, by obtaining duly signed receipt.

Application forms received after last date and by Post/courier, Email/Fax will not be considered and no communication will be entertained in this regard.

Admitted candidates under this admission process are NOT ELIGIBLE to participate in the Centralized Allotment Process (CAP) to be conducted for other Engineering colleges by Directorate of Technical Education (DTE), Mumbai for the academic year 2008-09.
